Fibo Math School (“Fibo Math School”, “Fibo”, “us”, or “we”) is committed to protecting your privacy. The purpose of this Privacy Policy is to describe what information we collect, how we use it, and what rights you have in relation to it. If there are any terms in this privacy notice that you do not agree with, please discontinue use of our services immediately.

Fibo is a service that allows registered parents or guardians (“Parents”) to enroll students (“Fibo Kids'', you) in online small-group classes (the “Services”). This Privacy Policy describes what personal information Fibo collects from registered Parents and Fibo Kids, as well as how Fibo collects and uses personal information from visitors to our public website (collectively, “Sites”).

We take extra precautions for our youngest Fibo Kids. Specifically, we have designed the platform registration process to minimize the collection and use of personally identifiable information.

We understand how important privacy is to you, and we are committed to creating a safe and secure environment for learners of all ages. We use the data we collect to provide you with a better experience and fulfill our mission of providing a world-class education for anyone, anywhere.

  1. What Information Do We Collect

    When you visit our Site, we may collect information about you that, alone or in combination, could be used to identify you, your device, or household (“Personal Data”), as further described below. We collect Personal Data from you when you directly provide it to us, such as when you register for an Fibo account. For example, we collect your email address and a password. When you click on our email to verify your email address, we will collect your IP address and approximate location at the city or zip code level where you verified the email address. We may collect additional information from you if you contact our technical support team, send us an email, complete a user survey, or otherwise communicate with us.

    During account registration, we ask you to provide the name and age of your child. We recommend you select a nickname or silly name for your child’s username, and do not use your child’s real name, for additional security purposes. We do not ask for or collect any additional personal information from your child.

    More specifically, Personal Data may include these categories of data:

    Contact Information:

    • Name or publicly posted name from a Facebook linked account

    • Email address

    • Phone number

    • Postal and billing address

    Postal and billing address

    • Credit card or other payment information

    Demographic Data:

    We collect age, month and year of birth, gender, preferred pronouns, marital status, and similar demographic details. We strive to provide you with access to and control over the information you give us, and we take the protection of your information very seriously.

    Sensitive Data:

    Parents may voluntarily provide sensitive information such as health or disability information included in forms or messages sent to instructors to aid with learning. Instructors and Fibo Kids are otherwise not allowed to have discussions that may result in sharing of sensitive information.

    If we suspect that a child is over 18, for the safety of other Fibo Kids, we may request that a Parent show us a copy of age-identifying documentation, such as a child’s birth certificate, passport, or driver’s license. This documentation could show us sensitive data such as full date of birth, place of birth, and government ID numbers. Other than month and year of birth, we do not record this information.

    We may also receive sensitive information you have voluntarily provided when enrolling for classes; video of student image and audio of student voice during classes; content and communications that you may have voluntarily provided or uploaded, e.g., your profile photo or messages you share with the class; information voluntarily provided through reviews; notes you provide about yourself or your child when enrolling for a class.

    Passively Collected Data:

    When you use or interact with us through our Site, we and our third-party partners may collect, receive, and store certain data automatically.

    Usage data:

    We collect usage data (such as login times, search terms you used, and pages you viewed), and other information about your device and browser.

    Identifiers and device information:

    We collect IP Address, device identifiers such as cookie identifiers (more on cookies below), your device’s operating system type, and browser type. We may use such information and pool it with other information to track usage and device and system data, for example, the total number of visitors to our Sites, the number of visitors to each page of our website, and the domain names of your Internet service providers.

    Cookies:

    On our Sites, we and third parties that provide certain functionality to the Fibo Sites may use a technology called "cookies." A cookie is a piece of information that the computer that hosts our Sites gives to your browser when you access the Sites. Our cookies help provide additional functionality to our Sites and help us analyze Site usage more accurately. On most web browsers, you will find a “help” section on the toolbar. Please refer to this section for information on how to receive a notification when you are receiving a new cookie and how to turn cookies off. We recommend that you leave cookies turned on because they allow you to take advantage of some of our Sites’ features. For more information about our use of cookies, please see the section entitled “Cookie Policy” below.

    Inferred Data:

    We may infer new information from other data we collect, including using passive, automated means, to generate information about your likely interests (“inferences”). For example, we infer the class subjects your family may be interested in from searches you may perform. We may also infer your general geographic location (such as city, state, and country) based on your IP address.

    Aggregated Personal Data:

    We may aggregate data, including Personal Data, and use such aggregated data for any purpose. This aggregate information does not identify you personally.

    Required Personal Data:

    Some Personal Data is required such as credit card payment used by Parents to purchase classes and for verified parental consent. instructors are also required to let us access Personal Data relating to background checks. instructors are also required to have their cameras on while teaching a live class. Fibo Kids are required, subject to authorized exceptions, to have their video enabled at least at the start of class to verify their identity to protect the safety of other Fibo Kids. You may decline to provide certain Personal Data.

    Sources of Personal Data:

    You are the main source of Personal Data we have about you. We may also obtain any of the above categories of information from third parties. These third-party sources include, for example:

    • Third party partners. Third party applications and services, including social networks you choose to connect with or interact with through our services.

    • Co-Branding/Joint Partners. Partners with which we offer co-branded services or engage in joint marketing activities.

    • Service providers. Third parties that collect or provide data in connection with work they do on our behalf, for example companies that determine your device’s location based on its IP address.

  2. How we use the information we collect

    We may use any of the above categories of your Personal Data to:

    • provide and enhance the Fibo services, including troubleshooting, maintaining, improving, and personalizing the Fibo Math School website;

    • business operations, such as processing your payment for the Fibo Services, billing, accounting, improving our internal operations, securing our systems, detecting fraudulent or illegal activity, and meeting our legal obligations;

    • send you emails or newsletters that you signed up for, including messages about new and recommended classes, events, and other marketing content we may send to Parents:

    • communicate with you to confirm registration and send updates, provide customers support and security alerts, and other administrative messages;

    • conduct research and develop new services or features; analyze website usage and usage of the Site features, content, and pages.

    We combine data we collect from different sources to achieve these purposes and to give you a more seamless, consistent, and personalized experience.

    Fibo instructors may access recordings of their classes and may use the recordings to improve their curriculum and classes and may provide the recording to Parents and Fibo Kids to view. Fibo may also use class recordings to provide feedback to instructors, for customer support, and for compliance purposes. Fibo will obtain additional parental consent before we use any class recordings for promotional or other purposes.

    Retention of Personal Data:

    We retain Personal Data for as long as necessary to provide the services and fulfill the transactions you have requested, comply with our legal obligations, resolve disputes, enforce our agreements, tax, accounting and other lawful business purposes.

    Storage and Transfer of Personal Data:

    Your information, including Personal Data, may be transferred to and maintained on computers located outside of your state, province, country, or other governmental jurisdiction where the data protection laws may differ from those in your region. If you are located outside the United States and choose to provide information to us, please note that we transfer the data, including Personal Data, to the United States and process it there.

  3. How we share or transfer data to others

    We do not rent or sell your personal information to third parties for their own purposes without your consent. We share or disclose your personal information only as needed to provide our service and in the following circumstances:

    Vendors and Service Providers: We may share information with our trusted vendors, third party service providers, and individuals to provide services or products for us or on our behalf, which may include hosting, email delivery, and business administration or professional services (e.g., legal advisors, accountants). We may share your Personal Data as necessary to complete your transactions and provide the services you have requested or authorized. For example, we use third parties to process credit card payments. When we share personal information with third party service providers or vendors, these third parties are contractually obligated to maintain the security and confidentiality of that personal information. We may share your Personal Data with third parties with your consent or authorization and with whom you have intentionally interacted.

    Aggregate or de-identified information: We may share information in aggregated and/or anonymous form that cannot reasonably be used to identify any individual.

    Merger or Sale: If we become involved in a merger, acquisition, bankruptcy, change of control, or any form of sale of some or all of our assets, your personal information may be transferred or disclosed in connection with the business transaction. In such an event, we will make efforts to require the new owner to abide by the terms of this Privacy Policy or to provide notice before your personal information is transferred and becomes subject to a different privacy policy.

    Other: We may disclose personal information if we have a good faith belief that such disclosure is reasonably necessary to (a) satisfy any applicable law, regulation, legal process, or enforceable governmental request; (b) enforce applicable Terms of Service, including investigation of potential violations thereof; (c) detect, prevent or otherwise address fraud, security or technical issues; (d) protect the rights, property, or personal safety of Fibo Math School, our users or the public; or (e) as required or permitted by law.

  4. Marketing, advertising and email communications

    Email communications. Fibo Math School may, from time to time, send you email regarding our products and services, or products and services we think you may enjoy. Only Fibo Math School (or our vendors or service providers operating on our behalf) will send you these emails. You can choose not to receive these emails by clicking the unsubscribe link in any email. Please note that you are not permitted to unsubscribe or opt-out of non-promotional messages regarding your account, such as account verification, changes or updates to features of the Platform, or technical or security notices.

    Interest based advertising. We do not display any targeted advertising in the Fibo Math School Platform. We do not permit third parties to collect information about your use of the Fibo Math School platform for the purpose of sending you targeted advertisements on other websites or applications.

  5. How to access, update or delete your personal information

    Please contact us at fibokids@fiboschool.com to update or delete your personal information.

    We may not be able to delete information in all instances, such as information retained in technical support logs and other business records. We may retain information which has been de- identified or disassociated with personal identifiers such that it can no longer be used to reasonably identify a particular individual.

    Unless we receive a deletion request, we will retain your information for as long as your account is active or as is reasonably useful for operational purposes. We may also retain information which has been de-identified or aggregated such that it can no longer reasonably identify a particular individual.

  6. Our approach to data security

    Data security is important to you, and to us. We use certain physical, managerial, and technical safeguards designed to preserve the integrity and security of your personal information and other information we maintain in connection with our Platform. However, no security system is impenetrable, and we cannot guarantee the security of your personal information. In the event that any information under our control is compromised as a result of a breach of security, we will take reasonable steps to investigate the situation and will notify you of the security incident in accordance with applicable laws and regulations.

  7. How do we protect Children’s Privacy?

    Because Fibo Math School is a learning environment for children, we take additional measures to safeguard children’s privacy, including for children under the age of 13. Our Platform is intended to be used by children under 13 only with the consent and oversight of a parent or by a teacher or school for use as part of the school's curriculum, as explained in Section 8 below. An adult with a verified email address must download the Platform and create an account before permitting a child to use the Platform. Please contact us at fibokids@fiboschool.com if you believe we have inadvertently collected information from a child under 13 without consent from a parent or guardian so that we may delete the information as soon as possible.

    The following applies when a child uses the Platform with a parent’s consent and oversight:

    We collect the username and age of a child provided by the parent. We collect usage information when a child or parent uses the Platform, which we associate with the parent’s information. We do not collect other personal information from the child.

    We use this information to operate, personalize, maintain, enhance, and provide all of the features of our Platform. We do not use this information for marketing or advertising purposes.

    We share the information only with our service providers, others in the Fibo Math School family, and otherwise as described in Section 3 above. We do not share the child’s information with third parties for their own purposes.

    To permanently delete the child’s information from our systems, a parent should contact us at fibokids@fiboschool.com.

European Union Data Protection

For personal data subject to the European Union General Data Processing Regulations (GDPR), we rely on several legal bases to process the data. These legal bases include where:

The processing is necessary to perform our contractual obligations in our Terms of Service or other contracts with you (such as to provide you the Platform as described in our Terms of Service);

You have given your prior consent, which you may withdraw at any time (such as for marketing purposes or other purposes we obtain your consent for from time to time);

The processing is necessary to comply with a legal obligation, a court order or to exercise or defend legal claims;

The processing is necessary for the purposes of our legitimate interests, such as in improving, personalizing, and developing the Platform, marketing the Platform, such as new features or products that may be of interest, and promoting safety and security as described above.

Residents in the European Union are entitled to certain rights with respect to personal information that we hold about them:

Right of access and portability. The right to obtain access to your personal information, along with certain related information, and to receive that information in a commonly used format and to have it transferred to another data controller;

Right to rectification. The right to obtain rectification of your personal information without undue delay where that personal information is inaccurate or incomplete;

Right to erasure. The right to obtain the erasure of your personal information without undue delay in certain circumstances, such as where the personal information is no longer necessary in relation to the purposes for which it was collected or processed;

Right to restriction. The right to obtain the restriction of the processing undertaken by us on your personal information in certain circumstances, such as where the accuracy of the personal information is contested by you, for a period enabling us to verify the accuracy of that personal information; and

Right to object. The right to object, on grounds relating to your particular situation, to the processing of your personal information, and to object to processing of your personal information for direct marketing purposes, to the extent it is related to such direct marketing.

California Resident Data Protection

If you are a California resident, you have certain legal rights related to your Personal Information. Except as otherwise provided or excepted by applicable law, you may exercise the following rights:

  1. Right to Know/Portability: You have the right to request that we disclose to you certain information about Personal Information we collected about you within the past twelve months. Once we confirm your verifiable request, we will disclose to you:

    • the categories of Personal Information we have collected about you;

    • the categories of sources from which the Personal Information is collected;

    • our business or commercial purpose for collecting Personal Information;

    • the categories of third parties with whom we share Personal Information; and

    • the specific pieces of information we have collected about you.

  2. Right to Opt Out: You have a right to opt-out from future “sales” of personal information. Note that the CCPA defines “sell” and “personal information” very broadly, and some of our data sharing relating to cookie data and other tracking methods used for analytics and advertising purposes described in this Privacy Policy may be considered a “sale” under those definitions. To opt-out of this limited “sale” of personal information, please email contact@fiboschool.com with subject “Do Not Sell My Personal Information”.

    We do not “sell” the Personal Information of consumers we know are less than 18 years of age, unless we receive affirmative authorization (the “right to opt in”) from either the consumer who is between 13 and 18 years of age, or the parent or guardian of a consumer less than 13 years of age. Consumers who opt into Personal Information sales may opt out of future sales at any time.

  3. Right to Deletion: You have the right to request deletion of your Personal Information that we collected from you and retain, subject to certain exceptions. Once we confirm your verifiable request, we will delete (and direct our service providers to delete) your Personal Information from our records, unless an exception applies.

  4. Right to Non-Discrimination for Exercise of a California Privacy Rights: We will not discriminate against you because you exercise any of the above rights, or any other rights under the CCPA. Specifically, if you exercise your rights, we will not deny you access to our services, charge you different prices or rates for services or provide you a different level or quality of services.

  5. How to Submit A Request: You may submit a request to exercise the rights listed above by emailing us at contact@fiboschool.com. In your request, please include (1) full name used to create your account; (2) email with which you created your account; (3) phone number in case we need to contact you to securely verify your request; (4) whether you are requesting how your information is used and/or to delete your Personal Information.

  6. Verifiable Request: As required under applicable law, we take steps to verify your identity before responding to your request. We may require you to provide information sufficient enough to allow us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative. We may limit our response to your exercise of the above rights as permitted under applicable law.

  7. Agent Authorization and Disability Access: You may designate an authorized agent to make a request on your behalf. As permitted by law, we may require additional verification in response to a request even if you choose to use an agent. You may also make a verifiable consumer request on behalf of your minor child.   8. Responding to Requests: We will confirm receipt of your request within 10 days from receipt and provide information about how we will process the request, our verification process, and when you can anticipate a response to the request. We will use commercially reasonable efforts to honor your request within 45 days from receipt. If additional time is needed, we will notify you of the same, along with an explanation and anticipated timeline for the extension which shall not exceed 90 days from the date of receipt.

  9. “Shine The Light Lawrence” California Civil Code Section 1798.83 permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us using the contact information provided below.

Cookie Policy

Cookies are small text files containing a string of characters that can be placed on your computer or mobile device that uniquely identify your browser or device. Cookies are used with web beacons and similar technologies. Web beacons are electronic images (also called single-pixel or clear GIFs) that are contained within a website or email and can read cookies they place on your device.

Cookies and similar technologies allow a site or service to know if your computer or device has visited that site or service before. Changes to Our Privacy Policy

We may change this Privacy Policy and will post or provide appropriate notice or obtain consent regarding such changes as required by law.
